Welcome to Pishee ("we," "our," or "us"). We are a Dutch-Latvian company dedicated to bridging the gap between casual gaming and professional language tutoring through our immersive, AI-powered platform.
By creating an account, accessing, or using Pishee (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use Pishee.

2. The Service & AI Technology
2.1 What We Do
Pishee is a language learning ecosystem. We provide structured lessons, cultural context videos, and AI-driven conversation practice ("The Pishee AI Tutor"). Our unique "Universal Content Engine" allows you to learn a target language using instructions in your native language.
2.2 Use of Generative AI
Our Service heavily relies on Generative AI. By using Pishee, you acknowledge and agree to the following:
Third-Party Models: We utilize models from providers including, but not limited to, Google, OpenAI, Anthropic, Microsoft, as well as our own proprietary custom models.
Accuracy & Hallucinations: AI is a powerful tool, but it is not infallible. While our core curriculum is crafted by vetted language tutors, the instructional layer is translated and adapted by AI. Occasional translation errors, cultural inaccuracies, or "hallucinations" (incorrect facts) may occur. Pishee is provided for educational purposes; please do not rely on it for critical, life-altering translations (e.g., legal or medical advice).
The "Pishee AI Tutor": Our AI tutor analyzes your input to provide feedback. You understand that this feedback is automated and generated by algorithms.
2.3 Service Availability
Our platform is hosted via Laravel Cloud. While we aim for 99.9% uptime, we do not guarantee that the Service will be uninterrupted or error-free.
3. Your Data, Voice, and Privacy
We take your privacy seriously, especially regarding biometric data (voice) and AI training.
3.1 Data for Training & Improvement
To improve our custom models and the "Universal Content Engine," we analyze user interactions, including text answers and voice inputs.
Anonymization: We strictly anonymize your data before it is used for any model training or analytics. Your personal identity is stripped from the learning data.
License to Use: By using the Service, you grant Pishee a worldwide, non-exclusive, royalty-free license to use your anonymized text and voice inputs for the specific purpose of improving our AI models, analytics, and creating internal data assets.
3.2 Voice Data Restrictions (Our Promise to You)
We recognize the sensitivity of voice data.
No Voice Cloning: We will never use your voice data to create a "deepfake" or clone of your specific voice identity.
No Selling: We do not sell your raw voice data to third parties.

4. Subscriptions & Payments
Pishee offers three primary access tiers: Monthly Subscriptions, Annual Subscriptions, and Lifetime Licenses.
4.1 Billing
Recurring Billing: Monthly and Annual subscriptions auto-renew until cancelled. You must cancel at least 24 hours before the renewal date to avoid being charged for the next cycle.
Lifetime License: This is a one-time payment granting you access to the Service for the lifetime of the product (the duration the Service remains commercially available).
4.2 Refund Policy
We strive to be fair. Our refund policy is based on the commitment length of your plan or the type of purchase:

Monthly Subscription
14-Day Guarantee: You may request a full refund within 14 days of your initial purchase. After this period, monthly payments are non-refundable.
Coins (Virtual Currency)
Non-Refundable: All purchases of Coins or virtual items are final and non-refundable.
How to Request a Refund: Please contact support at support@pishee.com with your transaction ID and your account's email address.
EU Right of Withdrawal: If you are an EU consumer, you have a statutory 14-day right of withdrawal. We have extended this right to all users globally for all subscription types. However, strictly regarding Virtual Coins, by purchasing and immediately receiving these virtual goods, you acknowledge that you lose your right of withdrawal once the Coins are credited to your account.
5. Gamification & Virtual Goods
Pishee makes learning fun through gamified elements like streaks, leagues, and virtual items.
5.1 Streaks & Leagues
Daily Streaks: You build a streak by completing at least one lesson or practice session per day.
Weekly Leagues: You earn points for completing lessons and practices. Based on your total points relative to other users in your league at the end of the week, you may be:
Promoted: Moved to the next higher league.
Demoted: Moved to the previous league.
Retained: Remain in the current league.
No Property Rights: Your status in leagues, your streak count, and your accrued points are part of the Service's logic and do not constitute personal property. We reserve the right to modify the scoring rules, league structure, or reset stats at any time without liability.
5.2 Virtual Currency ("Coins") & Items
Coins: You can earn virtual "Coins" by practicing or purchasing them via our store. Coins can be used to acquire virtual items such as:
Streak Freezes: To protect your streak if you miss a day.
Double XP / 1.5x XP Tokens: To accelerate your point collection.
License Only: Coins and virtual items are a limited, non-transferable, revocable license to use a feature of our App. They have no real-world monetary value and cannot be redeemed for cash or transferred to other accounts.
Usage: Coins earned via gameplay and Coins purchased are treated identically within the app environment.
6. User Conduct
You agree to use Pishee responsibly. You must not:
Reverse Engineer: Attempt to decompile, reverse engineer, or scrape our source code or our proprietary Universal Content Engine data structures.
Abuse the AI: Feed the AI strictly prohibited content, including hate speech, violence, sexually explicit material, or illegal acts.
Game the System: Use bots or automation to interact with the Service, specifically to artificially inflate streaks, points, or league standing.
Share Accounts: Your license is personal. Sharing login credentials with others is prohibited.
We reserve the right to suspend or terminate your account immediately if you violate these rules.
7. Intellectual Property
7.1 Our Content
All content, design, graphics, video lessons, code, and the specific arrangement of the "Universal Content Engine" are the intellectual property of Pishee or its licensors.
7.2 Your Input
You retain ownership of the original content you type or speak into the app. However, as stated in Section 3.1, you grant us a license to use this data in an anonymized format.
8. Disclaimers & Limitation of Liability
8.1 "As Is" Basis
Pishee is provided "as is" and "as available." We adhere to high educational standards, but we do not warrant that the Service will result in any specific level of language fluency.
8.2 Limitation of Liability
To the fullest extent permitted by applicable law (Dutch/Latvian law), Pishee shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.
In no event shall our total liability to you exceed the amount you paid to Pishee in the twelve (12) months preceding the claim.
9. Governing Law & Dispute Resolution
9.1 Governing Law
These Terms are governed by the laws of The Netherlands.
(Note: As a Dutch-Latvian company, we utilize Dutch law as our primary jurisdiction for consumer protection stability, but this does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law of your country of habitual residence).
9.2 Dispute Resolution
We prefer to resolve things amicably. If you have an issue, please contact us first. If we cannot resolve it, disputes will be submitted to the competent courts in The Netherlands.
10. Updates to These Terms
We may update these Terms to reflect changes in our AI technology, legal requirements, or business features. We will notify you of material changes via email or a prominent notice to your registered email. Continued use of Pishee after such changes constitutes acceptance.
